Constitutional Law

Fundamental rights, institutional law and procedures, and the financial constitution. Constitutional law shapes our entire legal system, which is why constitutional questions arise in all areas of law.

The law firm's range of services ranges from constitutional opinions to advice on the constitutional and Union lawfulness of draft laws, the legislative implementation of Constitutional and Union Courts' decisions in legislative proceedings to legal representation in constitutional proceedings.

We particularly represent before the Constitutional Court in Vienna in the following proceedings:

  • Complaints against decisions of the administrative courts according to Art 144 B-VG ("E proceedings");

  • Legal review procedure according to Art 140 B-VG ("G proceedings");

  • Ordinance review procedure according to Art 139 B-VG ("V proceedings");

  • Election disputes;

  • Contesting referenda and European citizens' initiatives; and

  • Disputes from parliamentary committees of inquiry.

In relation to European and international law – in particular the Charter of Fundamental Rights of the European Union, the fundamental freedoms of the European internal market and the European Convention on Human Rights – we also represent before the Court of Justice of the European Union in Luxembourg and the European Court of Human Rights in Strasbourg.
